General

  1. The website www.almarieswim.com (hereinafter: “the Website”) is operated by ALMARIE Design Studio LTD, BN no. 515175545 (hereinafter: “the Company”) and serves as an online store for purchasing swimwear and lingerie (hereinafter: “the product”) by means of the internet. 
  2. The use of our website is subject to the conditions specified in these Terms and Conditions of Use. Please read these Terms and Conditions carefully, since by accessing and using the Website, you agree to the terms contained in the Terms and Conditions. Your use of this website constitutes a binding contract between you and the Company.
  3. The terms set forth below apply to all genders and any reference in the male form is for convenience only.

Online Purchases

  1. The Website offers its customers a convenient, easy, and safe purchase of products online. 
  2. The Company reserves the right to change the range of the products offered on the Website, to replace the products, and to deny you the right to purchase the products at the Company’s sole discretion and without prior notice. 
  3. The prices listed for each product on the Website are the most current prices. The Website reserves the right, from time to time, to update the prices of products featured on the Website, regardless of the purchase time and without prior notice.
  4. The purchases on the Website will be paid for by credit card or by any other payment instrument listed on the payment web page.

Returns and Cancellation Policy
  1. The Company reserves the right to cancel the order and refund the customer’s payment in the following cases: an error in the product description, lack of stock, disagreement with the customer on one of the terms and conditions of the transaction and/or shipping, inability to contact the customer by means of contact details that were provided, absence of any other essential details. 
  2. According to Regulation 6(a)9 of the Israel Customer Protection Law (Cancellation of Transaction) 2010, all lingerie, including swimwear, cannot be returned or refunded. 
  3. If you place an order and wish to cancel it, you will be able to do so only if the product has not been shipped. Cancellation of the order before shipment will not incur additional payment, and the customer will be refunded the amount of the purchase price, including shipping. The monetary refund will be provided in accordance with the law. 

Shipping and Delivery Policy

  1. The Website will make sure to deliver the order within 5 business days to the address provided by the customer when placing the order. A courier will schedule with you the exact time of delivery before arriving. 
  2.  There might be delays in delivery to distant destinations, such as Eilat, Arava, settlements beyond the Green Line, and the Golan Heights. We cannot guarantee delivery within 7 business days to these destinations.

  4. The Company will not be responsible for any delay and/or tardiness in delivery of your order and/or failure to deliver as resulting from force majeure or due to circumstances beyond the Company’s control.

Database

  1. With regards to the personal information required to place an order on the Website, you will be asked to provide only the details required directly to complete the purchase of products. 
  2. The collected information will be stored in the Company’s database under its responsibility. This information will be used in keeping with this Privacy Policy or as required by any applicable law, in order to:
    • Provide the possibility to order various products on the Website.
    • Purchase products – including publication of information and content.
    • To display advertisements relevant to your interests when you visit the websites. The Company will use mainly statistical data that does not identify you as an individual. 

Data Sharing with Third Parties

  1. The Company will not share your personal information and the data collected about your activity on the Website with any third parties, excluding the following:
    • If you will purchase products from a third party that offers them on the websites, the third party will receive the data required to complete the purchase. 
    • In case of a judicial dispute between you and the Company that will require disclosure of your personal information.
    • If you perform illegal actions on the websites. 
    • If the court order compels the Company to share your personal information with a third party. 
    • If the Company sells or transfers in any way the operation of the Website to any corporation, and in case the Company merges with another entity or if it merges the operations of the Website with a third party, provided this corporation will be subjected to the provisions of the Privacy Policy. 

Security and Privacy Policy

  1. The Company implements up-to-date information security systems and protocols on its Website. Although these systems and protocols reduce the risks of unauthorized access, they do not provide absolute security. Therefore, the Company does not guarantee that the Website will be completely free from unauthorized access to the data stored therein.
  2. The company will take all reasonable precautions to maintain the confidentiality of the information to the fullest extent possible. The data is encrypted and transferred utilizing SSL protocol. 
  3. Any transfer of a credit card number from the Website is encrypted according to standards. In circumstances beyond its control and/or arising from force majeure, the Company will not be liable for any damage of any kind, direct or indirect, suffered or incurred by the customer or anyone representing them.
  4. The Company guarantees that it will not use the customer’s information registered on the Website for any purpose other than the operation of the Website, to enable the purchase and to keep in touch with the customer. In any case, the information will not be shared with a third party without the customer’s consent. 

Confidentiality of User Information and Data

  1. To purchase one or more of the products, you will have to fill in your details. This information will be shared with the Company. 
  2. Some details, such as your name and address, products you requested to purchase, your payment method, etc., identify you as an individual. You provide this information voluntarily and knowingly when you purchase a product. 
  3. Some of the information does not identify you personally and is not stored along with your personal information. It is statistical aggregated information. 
  4. The Company guarantees that it will not use the data of those who order on its Website, for any purpose other than the operation of the Website and the realization of the purchase with all that it entails.
  5. The company takes every reasonable precaution to ensure data confidentiality. 
  6. When you browse the Website, third-party web service providers such as google analytics will collect statistical data, in order to improve the service. The Website will not disclose personal data provided by the user to third parties unless required to do so by a competent authority or in any case of violation of the Terms and Conditions or for legal purposes as required by law. 
  7. Notwithstanding the foregoing, we hereby clarify that any data transferred over the internet may be read or captured by others, and the Company is not liable for any malfunction and/or data breach which will result in the disclosure of user data and/or any other information, but it will do everything in its power to prevent it.
    Transactions on the Website are secured with the SSL protocol and PCI Level 1 Security Standard.  

Intellectual Property

  1. All intellectual property rights in this commercial Website are the exclusive property of the Company.
  2. No information from this commercial Website may be copied, reproduced, distributed, published, or used in any other way without prior authorization by the Company.
